Official Contest Terms and Conditions

1. Who is running the Contest

This Contest is run by Bookatable Limited (trading as TheFork) (the “Promoter”), registered in England and Wales under company number 04494036, the registered office of which is at 7 Soho Square, London W1D 3QB (“TheFork”).

2. Eligibility

To participate you must be resident in the UK and aged 18 or over and a registered user of TheFork. Employees (and immediate family members and households of employees) of TheFork or any of its group companies, or its agencies or suppliers associated with this Contest, are not eligible to enter. No purchase is necessary in order to enter. Only one entry per person is permitted.

3. How to enter

You must submit your entry between the Opening Date and Closing Date stated in, and by the method described on the main Contest page accessible via the link provided in the email that you received (“Contest Page”). You must ensure that all details included with your entry are true and accurate. We cannot accept entries after the Closing Date. All Contest entries received for any reason after the Closing Date are automatically disqualified. We are not responsible for Contest entries that are lost, mislaid, damaged or delayed in transit, regardless of cause. The use of automated entry software, mechanical or electronic devices that allow an individual to automatically enter the Contest is prohibited and will render all such entries void. By submitting a Contest entry, you agree to be bound by these terms and conditions.

4. Selection

Winner will be chosen according to the method set out on our Contest Page. This selection will be random through excel document.. The decision of TheFork will be final and no correspondence will be entered into.

5. Notification of winners

We will contact the winner and any runners up within 7 days of the Closing Date, by using the email address provided with the Contest entry. Losers will not be contacted, however if you have any questions on the contest, please contact @email.

6. The Prize

The Prize is described on the Contest Page. Prizes must be redeemed within 10 days after the Closing Date Any Prizes not redeemed in that period will be forfeited without replacement. The Prize will be dispatched to the winner to the email address provided to us by the winner. We are not responsible for any prizes that are lost, delayed or damaged in the post. The Amazon Gift Card must be used by the date stated on it. If it is unused after that date, it will automatically lapse and cannot be refunded or exchanged for anything. Use of the Amazon Gift Card is subject to the Amazon Gift Card’s terms and conditions stated here. We will make all reasonable efforts to contact you if you have won a prize. If you cannot be contacted or you have not claimed your prize within 10 days from our first email, we reserve the right to offer the Prize to the next eligible entrant selected from the entries that were received before the Closing Date. We do not accept any responsibility if you are not able to take up the prize. If, for any reason, the Prize described on our Contest Page is unavailable, we may substitute a prize of equal or greater value. Prizes are non-exchangeable, non-transferable, and cannot be sold or exchanged for cash. Any additional travel and accommodation costs not mentioned are at the expense of the winner.

7. Ownership of Contest entries and intellectual property rights

All Contest entries and any accompanying material (“Materials”) submitted to us will become our property on receipt and will not be returned. By submitting your Materials, you agree to: assign all your intellectual property rights with full title guarantee to us, and waive all moral rights in and to your Contest entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world. You warrant that: you are the sole legal and beneficial owner of all rights and interests in the Materials the Materials do not contain anything that is unlawful, infringes any third party’s privacy or intellectual property rights or is defamatory, rude, offensive, hateful, discriminatory, obscene or otherwise objectionable. You agree that if any of these warranties are untrue, in whole or in part, that you will indemnify and hold TheFork harmless from any liabilities, losses, damages and expenses (including but not limited to reasonable legal fees) arising out of or in connection with any claim or suit based upon the allegations, which if true, would be a breach of the warranties above.

8. Data Protection and publicity

We will only process your personal information as set out in the Privacy Policy. TheFork requires your personal information in order to conduct the Contest. If you do not provide the mandatory personal information requested then you will not be able to take part in the Contest. TheFork will use the entrants’ personal information to administer the Contest, announce the winner(s) and disclose the entrants’ personal information to organisations that assist TheFork with administering the Contest and announcing the winner(s), and to third parties as required by law. An entrant may access and correct any personal information held by TheFork, upon request to TheFork.

9. Limitation of Liability

TheFork, its agents or distributors will not in any circumstances be responsible or liable to compensate you or to accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where any liability cannot be excluded by law. Your statutory rights are not affected.

10. General

If there is any reason to believe that there has been a breach of these Terms and Conditions, we may, at our sole discretion, reserve the right to exclude you from participating in the Contest. We reserve the right to void, suspend, cancel, or amend the Contest where it becomes necessary to do so. If any provision of these Terms and Conditions is found to be illegal or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that these Terms and Conditions can otherwise remain in full force and effect and enforceable to the fullest extent permitted by applicable law. Our failure to enforce our rights under these Terms and Conditions at any time and for any period shall not be construed as a waiver of such rights. These Terms and Conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
